Your employer is required by law to pay you every dollar you have earned. But wage theft is one of the most widespread and underreported labor violations in America.
It does not always look like a stolen paycheck. Wage theft happens when your employer:
• Rounds down your hours or shaves minutes off your timesheet
• Requires you to work through lunch breaks without pay
• Misclassifies you as an "independent contractor" to avoid paying overtime
• Fails to pay you time-and-a-half for every hour worked over 40 in a week
• Deducts pay for uniforms, tools, or equipment that drops your wages below minimum wage
Under the Fair Labor Standards Act (FLSA) and Illinois wage laws, you are entitled to every hour you worked. If your employer has been stealing from your paycheck, you may be owed back pay, damages, and attorney fees.
The statute of limitations on wage theft claims is limited. If you suspect your employer has been underpaying you, do not wait.
